1. Acceptance of Terms

By accessing or using CertGuard ("the Service"), operated by FreelyIT, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

CertGuard provides SSL certificate and domain expiration monitoring services. Our Service includes:

• Monitoring of SSL certificate expiration dates
• Monitoring of domain registration expiration dates
• Email notifications before expiration
• Dashboard for managing monitored domains
• Bulk import functionality (on applicable plans)
• Team collaboration features (on applicable plans)

3. Account Registration

To use the Service, you must:

• Create an account with accurate and complete information
• Be at least 16 years of age
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription Plans and Pricing

4.1 Free Plan

The Free plan allows monitoring of up to 5 domains at no cost. No credit card is required. Free plan features may be limited compared to paid plans.

4.2 Paid Plans

Paid plans (Pro and Agency) offer additional features and higher domain limits. Subscriptions are billed monthly. Prices are in Euros (EUR) and exclude applicable taxes.

4.3 Billing

• Payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods

4.4 Price Changes

We may change our prices with 30 days notice. Price changes will not affect your current billing period but will apply to subsequent renewals.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Monitor domains you do not own or have authorization to monitor
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service beyond normal usage
• Resell the Service without our written permission
• Violate the rights of others or applicable laws

6. Service Availability

We strive to maintain high availability of the Service. However:

• The Service is provided "as is" without guaranteed uptime
• We may perform maintenance that temporarily affects availability
• We will attempt to notify you of planned maintenance in advance
• We are not liable for service interruptions beyond our control

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of any data you provide to the Service. You grant us a license to use this data solely to provide and improve the Service.

8. Intellectual Property

The Service, including its design, features, and content, is owned by FreelyIT and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our software or content
• Reverse engineer or decompile the Service
• Use our trademarks without permission
• Remove any copyright or proprietary notices

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• We are not liable for damages resulting from expired certificates or domains
• We are not liable for missed notifications due to incorrect contact information
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless FreelyIT and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay applicable fees
• Request account deletion

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of the Netherlands.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FreelyIT regarding the Service and supersede any prior agreements.
